1. General
In these conditions of sale:
The Company means Dandy’s (Chester) Limited (Company No: 5033416), also trading as Dandy’s, Dandy’s Topsoil, Dandy’s Landscape Supplies Centre, Dandy's Nationwide Garden Supplies and Dandy’s Garden Centre.
The Customer means any person or business contracting with the Company for the supply of products or services.
Delivery means delivery by the Company or any haulier or third party acting on behalf of the Company.
These conditions may only be modified by a variation in writing signed on behalf of the Company by a Director.
Submission of an order online or confirmation of an order by any means shall be taken as acceptance of these Terms and Conditions.
Nothing in these terms shall limit or exclude any rights you have as a consumer under applicable law, including the Consumer Rights Act 2015.
2. Supply of Products
Products are sold on the following basis:
The Company shall take reasonable care to ensure that all goods supplied are of satisfactory quality and fit for their intended purpose at the point of delivery.
To the fullest extent permitted by law, the Company’s liability shall be limited to the value of the goods supplied.
The Customer acknowledges that the Company may supply goods via third-party manufacturers or suppliers. Any substituted goods will be of comparable quality and specification.
Drop Shipping and Third-Party Fulfilment
Dandy’s supplies certain products via a drop shipping arrangement. This means that, in some cases, goods are dispatched directly from our own warehouses or from carefully selected third-party manufacturers and suppliers.
Where third-party fulfilment is used, Dandy’s remains responsible for your order and contract of sale. However, by placing an order, you acknowledge and accept that:
- Products may be manufactured, packed, and/or dispatched by third-party suppliers on our behalf
- Delivery times may vary depending on supplier location and availability
- Packaging and branding may differ from standard Dandy’s products
- Orders may be delivered in multiple consignments
We take reasonable steps to ensure all third-party suppliers meet our quality and service standards. However, delays or issues caused by third-party suppliers may occur and may be outside of our direct control. To the fullest extent permitted by law, we shall not be liable for indirect or consequential losses arising from such delays.
Natural Product Variations
Due to the natural origin of many of our products, variations in colour, texture, size, and composition are to be expected and shall not be considered defects.
All weights and measures are approximate and quoted at the point of packing. Products sold by volume are filled and loaded using a Trading Standards-certified loading bucket. Bark products are compacted into bulk bags and handy bags, and as a result, the packaged volume may appear smaller. Loose loads are weighed using our Trading Standards-calibrated weighbridge. Weight notes must be requested prior to loading, as they cannot be issued retrospectively.
Product images are for illustrative purposes only and may not represent the exact product supplied - changes in colour, shape, texture and content may vary slightly. Samples can be requested.
Specific Product Notes
Turf is a natural, perishable product and must be laid within two hours of delivery and adequately watered. No claims will be accepted once turf has been laid.
Bark and similar products are measured at the point of loading using certified equipment. Settlement during transport is normal.
Rock salt and salt-based de-icing products are effective in helping to reduce ice formation and improve traction in cold conditions. Performance can vary depending on temperature, surface conditions, amount applied, and how quickly the product is cleared or diluted by rain, snow, or traffic.
Salt-based products may clump or harden if exposed to moisture or if stored in damp conditions. This does not necessarily indicate a fault with the product. To maintain performance, products should be stored in a dry location and kept sealed until use.
Where products have clumped or hardened, the material may be broken up and applied as normal. We do not accept responsibility for reduced performance caused by improper storage, moisture ingress after delivery, or conditions outside of our reasonable control.
Risk and Ownership
Risk in the goods passes to the Customer upon delivery.
Ownership of the goods shall not pass until full payment has been received.
Product Testing and Contamination
All products are subject to quality control and, where applicable, are produced in line with relevant British Standards, including BS 3882:2015 and PAS 100.
All Dandy's Chester Ltd products, including but not limited to topsoil, compost, and other landscaping materials, undergo stringent quality control measures prior to dispatch.
Dandy's Chester Ltd makes every reasonable effort to ensure that products meet the applicable British Standards at the point of supply, including BS 3882:2015 for topsoil and PAS 100 for compost where applicable.
Liability for Post-Delivery Contamination
Once delivery is completed to the customer’s specified site or address, Dandys Chester Ltd shall not be held liable for any contamination or alteration of the material, whether due to environmental exposure, airborne particulates, site conditions, or third-party interference.
The presence of asbestos fibres or any other contaminants in a post-delivery test result shall not be deemed as evidence of the original supplied material being defective or contaminated at the time of delivery.
Responsibility for Testing
Customers are responsible for arranging any independent laboratory testing prior to or at the point of delivery if they require assurance regarding material composition.
Any claims related to contamination must be supported by an independent test conducted on a sealed and uncontaminated sample taken directly from the delivered load immediately upon receipt before use, storage, or exposure to the surrounding environment.
Asbestos and Airborne Fibre Considerations
In accordance with The Control of Asbestos Regulations 2012, asbestos fibres are widely present in the UK environment, particularly on construction and demolition sites.Dandys Chester Ltd shall not accept liability for airborne asbestos fibres or other contaminants that may be introduced post-delivery due to external site conditions, including but not limited to ongoing demolition works, construction activities, or cross-contamination from third-party sources.
Claims and Dispute Resolution
Any claims regarding contamination must be submitted within 48 hours of delivery, accompanied by photographic evidence and an independent UKAS-accredited laboratory test result, demonstrating that the material was sealed and uncontaminated post-delivery. Failure to comply with this requirement shall render any claim null and void. In the event of a dispute, Dandy's Chester Ltd reserves the right to conduct an independent review, and liability shall be limited to the replacement of the goods in question if a defect is verified to have existed at the point of dispatch.
By accepting delivery of materials from Dandy's Chester Ltd, the purchaser acknowledges and agrees to these terms.
Any claims relating to contamination must be supported by independent UKAS-accredited testing and submitted within 48 hours. Failure to notify within this timeframe may affect our ability to investigate and resolve the issue.
Where a verified defect existed at the point of supply, liability shall be limited to replacement of the affected goods.
3. Complaints
Any issues with goods supplied should be reported in writing within 48 hours of delivery or collection.

Complaints should be sent to sales@dandys.com or the Company’s registered address.
4. Delivery
All pallet deliveries are made on a kerbside basis only.
At the driver’s discretion, delivery may be made onto private property (e.g. a driveway), if requested by the Dustomer, however this is done entirely at the Customer’s risk.
Dandy’s (Chester) Limited and its delivery partners accept no liability for any damage caused to surfaces, structures, or property beyond the public highway.
The Company will make every reasonable effort to deliver on the requested date. Delivery dates are estimates and not guaranteed. We shall not be liable for delays caused by events outside our reasonable control, including traffic, weather, supplier issues, or access restrictions.
The Customer is responsible for ensuring suitable access for delivery vehicles, including adequate space and ground conditions capable of supporting vehicles of up to 32 tonnes.
The Company shall not be liable for damage to property where tipper delivery is made in accordance with Customer instructions or where access conditions are unsuitable.
If delivery cannot be completed due to Customer error, including access issues, incorrect information, or absence, additional charges may apply.
Where a vehicle becomes stuck or delayed due to Customer instruction, associated recovery or waiting costs will be charged at £50 + VAT per hour.
Orders may be delivered in multiple consignments.
5. Cancellation and Returns
Cancellation must be confirmed in writing.
Orders cancelled prior to dispatch will receive a full refund.
Orders cancelled after dispatch will be refunded for goods only, excluding delivery and return costs already incurred by our courier.
The "14-day cooling off" period applies to products only and does not include bespoke topsoil or compost mixes, easily contaminated products such as sand, compost and topsoil, or living/perishable products such as turf and rock salt.
Bulk deliveries cancelled after dispatch may be subject to wasted journey charges.
Perishable goods, including turf and bespoke mixes, are non-refundable once dispatched.
Customers may return non-perishable goods within 30 days at their own cost, provided goods are unused and in original condition.
Refunds will be issued for goods only, excluding delivery costs.
This does not affect your statutory rights.
6. Quality and Use of Products
Dandy’s aims to supply high-quality products. Any concerns must be reported within 48 hours.
We cannot accept responsibility for goods that have been used, altered, or stored incorrectly.
Organic products may contain weeds due to their natural composition.
Budget-grade materials may contain stones or debris and are supplied as such.
Hoggin self-binding gravel should not be laid in unsuitable weather conditions. The Company shall not be responsible for failure where installation guidance has not been followed.
7. Customer Responsibilities
The Customer is responsible for:
- Ensuring access is suitable for delivery
- Ordering correct quantities
- Selecting appropriate products for intended use
- Checking goods upon delivery
- Any quantities suggested by the Company are estimates based on information provided by the Customer.
Packaging, including pallets and bulk bags, is non-returnable and must be disposed of responsibly.
8. General
By placing an order, the Customer confirms they have read and understood these Terms and Conditions.
Natural materials may vary between loads.
The Company shall not be liable for delays outside of its reasonable control.
These terms are governed by the law of England and Wales.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
